What is a K-1 Fiancé(e) Visa?
A K-1 nonimmigrant visa, also known as a fiancé(e) visa, allows a U.S. citizen to bring their foreign fiancé(e). In order to obtain a K-1 fiancé(e) visa, the marriage must take place within 90 days of the fiancé(e) entering the U.S. as a K-1 nonimmigrant. Once married, he or she may apply for a green card to become a lawful permanent resident in the United States.
Who can qualify for a K-1 Fiancé(e) Visa ?
K-1 Fiancé(e) visa eligibility is based on whether the fiancé(e) is brought in by a U.S. citizen, is legally free to marry, and intends to marry one another within 90 days of the fiancé(e)'s admission into the U.S. as a K-1 nonimmigrant.
Additionally, there must have been at least one in-person meeting within the 2-year period before filing the petition. The meeting requirement can be waived if proof can be provided that meeting in person would violate strict and long-established customs of the fiancé(e)'s foreign culture or social practice, or result in extreme hardship to the U.S. citizen petitioner.
